US president against ruling that curbs immediate deportations under the Alien Enemies Act, the 1798 law used to repatriate groups of Venezuelans

US President Donald Trump has pointed his finger at the Supreme Court, accusing it of preventing the government from deporting undocumented immigrants, including those with criminal records. “The Supreme Court will not allow us to deport criminals from the country,” the president wrote on his social Truth, commenting on the decision that represents a major blow to his administration.

In fact, the Court rejected the appeal with which the Trump administration attempted to use the Alien Enemies Act, a law dating back to 1798, to carry out rapid deportations of Venezuelan immigrants. With this provision, the government wanted to avoid ordinary court procedures, speeding up repatriations without having to wait for hearings under immigration laws.

According to CNN, the rejection represents a significant snub for the White House, which had counted on the Alien Enemies Act to strengthen its hard line against illegal immigration, especially in view of the elections.

The ruling thus confirms the limits in the application of historical legislation to contemporary cases, reiterating the need to respect the paths provided by the current judicial system for deportations, even against those who have committed crimes.
