The Prince Harry legal case faces escalating risks as judges warn of major financial consequences if the Duke loses his privacy lawsuit against the Daily Mail

The Prince Harry legal case is entering a far more dangerous phase, with judges warning that the Duke of Sussex could face eye-watering costs if his £38.8 million privacy lawsuit against the Daily Mail ends in defeat. The court has urged Harry and the other claimants to gain a “clear understanding” of the financial exposure linked to a dispute that has already generated substantial legal fees.

Seven high-profile figures — including Elton John, Sadie Frost and Elizabeth Hurley — accuse Associated Newspapers Limited of gathering private information through unlawful methods such as phone hacking, allegations the publisher dismisses as “grotesque” and “simply absurd”. As the trial scheduled for early next year approaches, judges stress that expenses will continue to rise sharply.

Although the group holds collective insurance worth more than £12 million, alongside individual policies, the court fears this protection may not cover the full impact if claimants lose or withdraw. Some could face significant personal financial risk. For Harry, the Prince Harry legal case could therefore become far costlier than anticipated when it was launched in 2022, with a verdict expected in January.
