Trump tariffs, Court of Appeals suspends ITC ruling: tariffs remain in force
Temporary halt to cancellation decided by the International Trade Court. Awaiting developments in the case before the Supreme Court
A new legal battle is underway in the United States on the trade front. A federal Court of Appeals has granted a temporary suspension of the decision by which, in recent days, the Court of International Trade had cancelled most of the tariffs imposed by the Trump administration.
According to NBC News, the suspension allows the government to keep the tariffs in place for now, avoiding their immediate cancellation. The measure will remain in effect while the Court of Appeals reviews the additional motions filed.
The Trump administration had already announced its intention to appeal to the Supreme Court on an emergency basis if the suspension did not come quickly. With today’s order, however, the appeal to the highest court could be temporarily frozen, pending the decisions of the second instance.
The Court’s order leaves the way open for further developments in what promises to be a protracted legal battle over the legitimacy of the use of presidential powers to introduce global and targeted tariffs, a move that had been ruled unlawful and abusive by the now-suspended ruling.
