Conservative majority approves Trump-backed measure: lower courts’ decision suspended, while legal challenges continue
The US Supreme Court has authorised President Donald Trump’s administration to implement a ban on transgender people serving in the military with immediate effect, lifting a stay imposed by a lower federal court. The decision was made by a six to three vote, with the liberal wing judges publicly dissenting.
The High Court has not yet addressed the merits of the issue, but with this move it allows the implementation of the executive order signed by Trump, while appeals in the federal courts continue. The measure marks a clear return to the restrictive line already attempted during the first presidential term, when a similar – albeit more permissive – version was temporarily applied, only to be repealed by President Joe Biden.
The decision represents a major turning point for civil rights in the USA, fuelling the national debate on access to military service for transgender people and presidential prerogatives in defence matters.
